MY ALLSTATE HORROR STORY

My fiancé, and one of our friends were going home from a fun night out on the town. We were in my fiancé's tiny Mitsubishi Eclipse (my fiancé was driving, I was in the passenger seat, and our 6'4 friend was in the back seat), driving down the highway in Dallas, and we see an accident that had just happened right ahead of us, so we slow down.
The accident takes up all but one lane. Cars are flying through all of the debris when we suddenly get nailed from behind. Our car goes flying everywhere, does a couple of 360s and slams into the retaining wall. The jaws of life are used to pull us out of the car (the top was ripped of to get us out since the car was so badly damaged), and I was taken to the emergency room (I was 4 months pregnant at the time of the accident).
The doctors told me that as a result of the impact, it was possible that I may have a miscarriage. Luckily that did not happen. Anyways, after we saw the police report, we found out that the driver of the car that hit us was doing excess speeds of 90 mph. We also discovered that he was a convicted felon, had been arrested for 2 prior dwi's, and was arrested at the scene for a third dwi!!
Of course Allstate would be stupid enough to ensure someone like that. Our car was totaled and taken to the pound where it was auctioned before the adjustor looked at it since they changed adjustors at least 3 times. After being put through hell, we were finally compensated for the car, but they wanted receipts for property damage loss, so we had to deal with that. I can tell we have a long road ahead of us dealing with this idiotic agency. They act like they are the injured party.

"There is no incentive for insurance companies to do what is right, such as live up to the promises made in their policies. Tort reformers fueled by insurance money think big business and the insurance industry need to be protected against "runaway juries." It's the other way around. Big business and the insurance industry have always been able to take care of themselves. The little people need protection from them. This country was founded on the common law right of the little guy to get into court with his hired gun to fight the oppressor, be it big government or big business. Take that away and we have nothing left. Look around. It's being whittled away, bit by bit, caps on damages here, restrictions on jury trials there. It won't end until we recognize the enemy and join together to take a stand against them. It will take the little people to do this together".
